jail和prison 都是監獄的意思，用法上有區分麽？

壹般詞典都將jail 和prison譯成“監獄”，不加區分，但有的字典對它們作了區分，如《牛津高階英漢雙解詞典》對jail的解釋是“=gaol”，而對gaol的翻譯是“監獄”，該字典對prison的翻譯是“監獄；看守所”。《大英漢詞典》也將jail譯為“監獄”，對prison的翻譯則是：1.拘留所、看守所；2.（尤指州政府及聯邦政府的）監獄。《英漢法律詞典》同樣將jail譯成“監獄”，而將prison翻譯為“監獄、牢獄；看守所、拘留所”。那麽，這兩個術語在漢語裏的功能對等詞到底是什麽呢？根據The Dictionary of Practical Law:

jail. A building used for the confinement of individuals awaiting trial, or who have been convicted of minor offenses. The term PRISON is sometimes used interchangeably with jail, but PRISON is usually the place where only those with long-term sentences are confined.

從這裏可知，jail和prison的功能對等詞不同，jail更接近中國的“看守所、拘留所”，prison的功能對等詞則應該是“監獄”。
